WACO, Texas (AP) 鈥� A U.S. District Judge has dismissed former Baylor football coach Art Briles and former athletic direcor Ian McCaw from a federal Title IX lawsuit, ruling no reasonable jury could find them negligent in the domestic violence assaults of a former Baylor student by a former Baylor football player.
In his ruling Friday, Judge Robert Pitman also threw out gross negligence claims against the university. But he will allow the jury to decide if the university was negligent and violated Title IX gender discrimination requirements.
Attorneys for Briles and McCaw said they were pleased.
“I am happy for Coach Briles. He did nothing wrong, and the things that people said he did he did not do,” Briles’ attorney, Reid Simpson, said.
Attorneys representing Baylor called a psychology professor who evaluated Dolores Lozano, the woman suing the university, before the judge recessed the jury for the weekend. Attorneys are set to give final arguments when the trial enters its seventh day on Monday.
