The West Virginia Office of Insurance Commissioner is accepting comments on potential changes to the state’s surplus lines export list, through Oct. 16.

By state law, the office maintains a list of coverages and classes that may be placed with surplus lines carriers, for insureds whose home state is West Virginia, the office said in a recent bulletin. Those classes on the list can be placed with non-admitted surplus lines insurers without completing a diligent search of admitted carriers.

The current list, approved in July 2022, . It includes many higher-risk categories, such as all-terrain vehicles, hot air balloons, go-cart tracks, rafting, skating rinks, nursing homes, fixed-base aviation operations, blasting and excavation contractors, and crop dusters.

Comments on what should be added or removed from the export list should be emailed to Greg Elam, associate general counsel, at Greg.A.Elam@wv.gov. To request that a class or item be added to the list, submitters should include evidence that there is not adequate coverage available in the admitted market, the office said.
